d\u00e9fense des droits et des libert\u00e9s) critically scrutinizes the Hungarian draft law entitled on \u201cTransparency in the Public life,\u201d submitted on 13 May 2025 by the ruling Fidesz Party.<\/p>\n\n\n\n<p>Malgr\u00e9 son titre qui semble anodin, le projet de loi constitue l\u2019attaque la plus vaste contre la soci\u00e9t\u00e9 civile, la libert\u00e9 des m\u00e9dias et la d\u00e9mocratie lib\u00e9rale en Hongrie depuis le retour au pouvoir de Viktor Orb\u00e1n.<\/p>\n\n\n\n<p>Most damning are the sweeping powers the draft law grants to the Hungarian Sovereignty Protection Office, enabling it to surveil, blacklist, financially penalize and dissolve any organizations deemed a threat to Hungarian \u201csovereignty\u201d \u2013 a term left dangerously vague.\u00a0 These powers are granted without adequate legal safeguards, and appeals are routed through the Hungarian Supreme Court (the K\u00faria), a judiciary whose independence has been increasingly compromised.\u00a0<\/p>\n\n\n\n<p>Le projet de loi cible les organisations recevant un financement \u00e9tranger minimal, y compris de sources europ\u00e9ennes, et impose des sanctions s\u00e9v\u00e8res sans garanties proc\u00e9durales ni recours juridique significatif.<\/p>\n\n\n\n<p>This report demonstrates that the draft law contravenes fundamental freedoms enshrined in the EU Charter of Fundamental Rights, the Treaty on the European Union, the Treaty on the Functioning of the European Union, as well as the binding case law of the European Court of Justice.\u00a0 It further highlights the draft law\u2019s misuse of anti-money laundering frameworks for political purposes and its serious implications for the EU as a single market, particularly for the free movement of capital and services.<\/p>\n\n\n\n<p>Compte tenu de la gravit\u00e9 que ce projet de loi repr\u00e9sente pour les normes d\u00e9mocratiques et l\u2019\u00c9tat de droit, tant dans l\u2019UE qu\u2019\u00e0 l\u2019\u00e9chelle internationale, ce rapport conclut par des recommandations politiques concr\u00e8tes adress\u00e9es aux organes comp\u00e9tents de l\u2019UE et au Conseil des droits de l\u2019homme des Nations unies (CDH).<\/p>\n\n\n\n<p>Il s\u2019agit notamment d\u2019appels \u00e0 :<\/p>\n\n\n\n<p>1) Proc\u00e9dure d\u2019infraction imm\u00e9diate engag\u00e9e par la Commission europ\u00e9enne ;<\/p>\n\n\n\n<p>2) Mesures provisoires devant la Cour de justice de l\u2019Union europ\u00e9enne ;<\/p>\n\n\n\n<p>3) Adopter une r\u00e9solution, au nom de l\u2019Assembl\u00e9e parlementaire du Conseil de l\u2019Europe et du CDH, condamnant le projet de loi et demandant sa suspension.<\/p>\n\n\n\n<p>L\u2019ASSEDEL appelle toutes les institutions concern\u00e9es \u00e0 adopter une r\u00e9ponse unifi\u00e9e et rapide pour emp\u00eacher un recul d\u00e9mocratique irr\u00e9versible, ainsi que pour prot\u00e9ger les freins et contrepoids nationaux en Hongrie et ailleurs
